Blue Grass Manor HOA Assessment Collections Policy & Liens:
Page 5 / Article VII: Assessment / Section 3: Default
Should any holder of a Full membership in the ASSOCIATION fail to pay the required assessment, he shall be given an additional thirty (30) days in which to make payment and shall be assessed a penalty not to exceed ten (10%) of the total amount due, said penalty to be determined by the Board, and should payment remain in default beyond that time, the Board shall terminate the right of the holder in default to use the Association Estate and the amount due shall become a lien upon the real property held by the Full Member in default and shall be subject to foreclosure in the manner provided by the laws of the State of Ohio…. In the event of legal action to collect past due assessment against a Full Member shall become necessary, said Member shall be required to pay all court costs and attorney fees incurred by the ASSOCIATION as a result of said court action (See Bylaws)
How Do I Rectify A Lien:
The homeowner will have to submit to our attorney:
Full payment for all past due assessments
All late fees
The amount to file the lien
The amount to lift the lien
If a lien is placed, the homeowner may make payments to the attorney or association until all debts and attorney fees are paid in full. Once all debts have been satisfied, the board will lift the lien.
How To Avoid A Property Lien/Penalty:
If you are having difficulty making the assessment payments, please make an effort to make payment arrangements with the board. Please note that a lien and/or other penalties will be instituted if payment arrangements are not upheld.
The board reserves the legal right to initiate a judgment that can lead to foreclosure or property seizure.
